DECISION OF THE BOARD

1. Michael Bouman is making a further appearance before the Board on a sentence of four years’ imprisonment for cultivating cannabis, possession of cannabis for supply and possession of equipment.  His statutory release date is 24 March 2018. 

2. This is Mr Bouman’s first time in prison.  He has accumulated some 11 convictions with three of those for driving with an excess breath alcohol level.  He has a Roc*RoI of 0.10778.

3. Whilst subject to this sentence Mr Bouman has successfully completed the Drug Treatment Programme.  He is working in the Enviro Waste recycling at the [Withheld] and is in the Self Care residences.  He received a positive report from his supervising officer. 

4. Mr Bouman was represented today by [Withheld], who made written submissions in advance of the hearing in support of his clients’ release on parole.  [Withheld] enlarged on those orally before us today.  He emphasised that Mr Bouman’s move away from old associates’ that he had a supportive address to go to in [Withheld]; and that he had the support of his former partner and family.  There were also employment or job opportunities available to him. 

5. He was supported at the hearing by [Withheld], [Withheld] and [Withheld].  The Board accepts that Mr Bouman is in the fortunate position of being able to advance a strong release proposal.

6. Having regard to that support and the progress Mr Bouman has made whilst subject to this sentence the Board is satisfied that his risk for the balance of his sentence can be managed by his release on parole conditions. 

7. Accordingly, we direct his release on parole on [Withheld] 2016.  Thereafter Mr Bouman will be subject to standard conditions and the special conditions, set out below, until his sentence expiry date.  The Board has adopted the proposed special conditions to provide for any of Mr Bouman’s ongoing rehabilitation needs.  We have added conditions relating to abstinence and any return into the area in which his offending occurred is to be managed through his Probation Officer.  Both of those conditions are imposed in the interests of reducing his risk of re-offending.

8. Release accordingly.  Special conditions as follows:
   (1) To undertake and complete an assessment for alcohol and drug counselling and complete any recommended counselling to the satisfaction of your Probation Officer.
   (2) To reside at [Withheld], and not to move from that address without the prior written approval of a Probation Officer.
   (3) To notify your Probation Officer prior to starting, terminating or changing your position or place of employment.
   (4) Not to possess or consume alcohol or illicit drugs.
   (5) Not to enter the Northland region without the prior approval of your Probation Officer.
