DECISION OF THE BOARD
- Donald Matthew Capon is making his first appearance before the Board on a sentence of four years six months’ imprisonment for importing prohibited goods, knowingly being concerned in the distribution of objectionable publications and possession of objectionable material knowing its status. He becomes eligible for parole on 13 January 2018 and he has a statutory release date of 12 January 2021.
- This is Mr Capon’s first term of imprisonment and his first recorded offending. It concerned extensive activity on the Internet involving child exploitative material.
- The parole assessment report records Mr Capon as being waitlisted to attend the Short Intervention Programme. He told us today that he understands he may be attending that programme around July next year. His PCO similarly advised the Board.
- So far as Mr Capon’s conduct and compliance is concerned, he presents no issues at all in his unit.
- When released from prison, Mr Capon is proposing to live with [withheld]. [withheld]. The parole assessment report refers to [withheld] living at the same address. There have been difficulties between Mr Capon and [withheld] in the past. We have raised with him the possibility of reflecting on how best to support [withheld] upon release and whether living at her address is necessarily the best release plan. That will no doubt occupy Mr Capon’s thoughts in the future.
- For today, parole must be declined. Until Mr Capon completes the Short Intervention Programme for which he is sentence planned, the Board could not be satisfied that his release would not pose an undue risk for the safety of the community. Parole today is declined. Mr Capon will be scheduled to return to the Board in 12 months, by 23 December 2018. He has been advised that should he complete the Short Intervention Programme well before that date, and have a solid release proposal, he may apply to return to the Board earlier.
