DECISION OF THE BOARD

1. Zakariye Mohamed Hussein is serving a sentence of six years, six months’ imprisonment for wounding with intent to cause grievous bodily harm, injuring with intent to cause grievous bodily harm, kidnapping and possession of an offensive weapon.  He has 10 months remaining on that sentence with a statutory release date of 16 September 2018.
2. Whilst Mr Hussein has served a significant period of his sentence in [withheld] he has, for the last two years, been the subject of an order under the Mental Health (Compulsory Assessment and Treatment) Act and is an inpatient at [withheld] pursuant to sections 45 and 30 of the Act.
3. The Board has received a report from his responsible clinician, [withheld], outlining the progress since Mr Hussein was last considered for parole.  He has remained in [withheld] and his condition has largely been stable.  There have, from time to time, been occasions where Mr Hussein has been violent towards hospital staff, the last one being in May of this year.
4. The report from [withheld] indicates that Mr Hussein is likely to remain an inpatient at the hospital and will be provided with ongoing opportunities to engage in psychological work targeting relapse prevention and violence risk management.  Provided his mental state remains clinically stable a graduated transition plan to the community will be considered in due course.  Mr Hussein’s future, however, appears to be managed through the Mental Health legislation.
5. Mr Hussein declined to attend the hearing today.  We note he also declined to provide consent to [withheld] for the preparation of the report for the Board.  Within the boundaries posed by that lack of consent, [withheld] very helpfully provided the Board with appropriate information.
6. While Mr Hussein remains subject to the Mental Health legislation he will not be subject to parole conditions.  Nevertheless, the Board could not be satisfied that if released with 10 months of his sentence remaining he would not pose an undue risk to the safety of the community.  Parole is formally declined.  Mr Hussein’s next hearing will be scheduled for July next year, by 31 July 2018, likely for the imposition of release conditions.
