DECISION OF THE BOARD

  1. Mr Marino is serving a sentence of 10 years imprisonment for rape of a female under 12, aggravated wounding and burglary.  Mr Marino was sentenced on 29 February 2012.
  2. The victim was five years old.  The sexual offending was brutal and violent.  Mr Marino was 16 years old at the time of the offending.  The impact of the offending on the victim and their family was significant.
  3. Prior to this extremely serious offending Mr Marino had no previous convictions.
  4. Ms Earl represented Mr Marino.  Ms Earl advises Mr Marino is not seeking parole.  He recognises that there is further work that requires his attention.  Mr Marino is being realistic.
  5. The prison security classification is low.  The parole eligibility date was 30 April 2015.  The sentence expiry date is 28 December 2021.  Mr Marino’s RoC*RoI is 0.739.  He has been identified as a high risk offender and he has been identified as having connections to the Mongrel Mob gang.
  6. Mr Marino is generally described as a quiet and compliant inmate.  He has employment as a shower cleaner.  Mr Marino had a misconduct in January 2017.
  7. The last psychological report was dated 5 March 2015.  Mr Marino has a history of alcohol and cannabis use from the age of 13 years.  He has been assessed as a high risk of general and violent offending and a moderate high risk for sexual offending.
  8. He has completed the DTU in 2016.  Reports identify that he engaged and participated well in that programme. [withheld]. At this time Mr Marino is undertaking the Child Sex Offenders Programme.  He is scheduled to graduate in March 2018.  He then has the maintenance sessions to complete.
  9. Mr Marino is also engaging in educational programmes.
  10. There is whanau support for Mr Marino.  His parents and his siblings continue to support him.  Mr Marino needs to complete the rehabilitative treatments.  Until he does engage in he after care sessions he continues to present an undue risk the safety of the community.
  11. Accordingly, parole is declined.  Mr Marino will be seen again in October 2018, at the latest at the end of that month.
  12. Mr Marino was advised that is not an indication that he will be released at that time, rather it is an opportunity to advise the Board on his progress and what re-integrative activities that he may be considering.
