DECISION OF THE BOARD
- Mr Kahui, who is 55 years of age was sentenced to preventive detention for multiple rapes of over 16-year-olds and unlawful sexual connection. There have been subsequent assaults in prison in 2012 and 2016. The victims have asked that Mr Kahui not be released to Auckland. Mr Kahui has a history of previous convictions, some 10 pages of violent offending, property offending and early sexual offending. He is assessed at being a high risk of sexual and violent offending.
- Mr Kahui refused to appear before the Board in 2021, and today refused to appear before the Board and waived his attendance. He has been identified to do both the Adult Sex Offender Treatment Programme and the STU:VO Programme. In the June 2023 hearing, he appeared but refused to see his Case Manager and refused to be interviewed by a psychologist. [withheld] was present at that time and after some discussion with him, it seemed as though he was prepared to work with [withheld] and a psychologist to help ready himself for the two rehabilitative programmes we have mentioned.
- As to the current situation, we note that his RoC*RoI is .91 his ASRS is 3. He has had three misconducts since we last saw him, one was having an unauthorised item, one dismissed for insufficient evidence and others involving damaging property and behaving in a threatening manner.
- As we have noted, he is identified to do the Adult Sex Offender Treatment Programme at Matapuna, as well as a Violence and Drug Treatment Programme. And the idea was that he would do one-on-one work, to get him ready for that treatment. Unfortunately, he has really made no progress since we last saw him. He has regularly refused to engage with a psychologist, who is trying to support him to get ready for the STU Programme. He has refused to engage with his Case Manager and overall, while initially he says that he will see a psychologist to review his position for the Board, he then changes his mind. Overall, therefore, as we have said, no progress since last time and Mr Kahui has essentially refused to work with Corrections to try and attend the STU Programmes he is identified for.
- We encourage Mr Kahui to see a psychologist, to start working on getting ready for those programmes and to attend the programmes so that he can reduce his risk and look forward in the longer term to a safe release into the community.
- All of this, even if he begins now and progresses by talking with a psychologist, it will be some considerable time before we could realistically consider him for release. We will see him again in just under two years’ time, in October 2026. In the meantime, for the reasons given, he is an undue risk.
